In February 2020, the Federal Constitutional Court ruled that the “ban on commercial promotion of suicide” that had existed since 2015 declared voidas it violated a right to self-determined dying.
Criticism of euthanasia applications
The German Foundation for Patient Protection classified the existing drafts as insufficient. “If the Bundestag wants to regulate organized assisted suicide, the self-determination of those willing to die must be strengthened and protection against heteronomy must be guaranteed,” quotes the “Neue Osnabrücker Zeitung” the head of the German Foundation for Patient Protection, Eugen Brysch: None of the three designs would meet these requirements.
The three drafts of euthanasia
According to a draft by a group led by Lars Castellucci (SPD) and Ansgar Heveling (CDU), “commercial promotion” of suicide should be a punishable offense – with one exception for adults: In order to make free decisions without internal and external pressure, two investigations should usually be carried out given by a specialist in psychiatry and psychotherapy at intervals of three months and a comprehensive, open-ended consultation. A group around Katrin Helling-Plahr (FDP) and Petra Sitte (Left) wants a new regulation outside of criminal law and a wide range of advice. Doctors should be allowed to prescribe drugs for suicide if they assume a “permanence and inner firmness of the wish to die” and at least ten days have passed since the consultation. (draft)
